A straight answer

Are there mortgage programs for attorneys and CPAs?

The direct answer

Yes. I offer professional mortgage programs for attorneys and CPAs. I review your license, how you are paid and the property, whether you draw a salary, partnership income or self-employment income. I'm Zach von der Linden (NMLS 1652805), a mortgage broker with West Capital Lending, based in San Clemente.

I offer the program with little or no down payment. It has no mortgage insurance. Deferred student loans can be left out of the debt ratio. An offer letter can be used.

The credential opens the program, and your pay structure decides the income rule. A salary needs no minimum history under Fannie Mae's rule. A new partner in a law firm does not always need two years of K-1s, under a Fannie Mae exception. An owner of a quarter or more of the firm is self-employed. I put the financing together with a lender; the lender and the program set the rules. I work with buyers in California, Utah, Oregon and Arizona.

What happens after you text me?

Texts go straight to my cell, and I answer them myself when I'm free. I'll ask for the few details that actually matter, tell you whether the structure looks worth pursuing, and explain the next step. If I don't think the loan fits, I'll tell you that too.

A text or phone conversation does not pull your credit.

What does the professional program change for attorneys and CPAs?

The professional program I offer covers attorneys and CPAs. It offers little or no down payment. It has no mortgage insurance. Deferred student loans can be left out of the debt ratio. The versions limited to your first 10 years in the profession apply only during those years.

An offer letter can be used. Can I get a mortgage with a job offer letter before I start? covers closing on an offer letter.

I am an associate or on staff. How is my pay read?

As fixed base income. Fannie Mae counts "a set salary" as fixed base income, and "A minimum history is not required for inclusion as qualifying income" (Fannie Mae Selling Guide B3-3.3-01). A bonus is read separately, under the variable pay rules.

I just made partner. Do I need two years of K-1s?

Not always. For an owner of less than a quarter of the firm, Fannie Mae asks for two years of signed personal returns and K-1s, and "A minimum two-year history is required" (Fannie Mae Selling Guide B3-3.4-19). Guaranteed payments to a partner do not count until you have received them for two years, with one exception.

Under that exception, a new partner is not held to the two-year history: "An exception to the two-year requirement of receiving "guaranteed payments to the partner" applies if a borrower has recently acquired nominal ownership in a professional services partnership (for example, a medical practice or law firm) after having an established employment history with the partnership" (Fannie Mae Selling Guide B3-3.4-19). The lender then may rely on the compensation your partnership agreement sets, rather than a K-1 history, backed by current year-to-date income.

I became a partner at work. Do I need two years of K-1s before I can buy? covers the K-1 rules in full.

I own my practice. What changes?

Owning a quarter or more makes you self-employed under Fannie Mae's rule (Fannie Mae Selling Guide B3-3.5-01). The lender generally wants a two-year history of your earnings. Less than two years can work when your latest signed personal and business returns show a full year from the current practice, and your prior work was in the same field at the same or greater income.

If your returns show less than the practice earns now, I also offer bank statement loans. Can I refinance or buy if my tax returns do not show what my business earns now? explains them.

What should I have ready?

Your bar or CPA license status, your recent pay stubs and W-2s, your partnership agreement and K-1s if you are a partner, your personal and business returns if you own the practice, and statements for the accounts that will cover closing. Do not text documents or account numbers; I will tell you what to send and how.

Questions people ask next

Does a bar card or CPA license qualify me automatically?

No. The license opens the professional program, and the lender still reads your income, debts, credit, funds and the property. How you are paid decides which income rule applies.

Are deferred student loans counted?

Under the professional program I offer, deferred student loans can be left out of the debt ratio.

Does the new partner exception cover an accounting firm?

Fannie Mae's exception covers "a professional services partnership," and its examples are "a medical practice or law firm" (Fannie Mae Selling Guide B3-3.4-19). Whether your accounting firm's structure fits is something I read in your partnership agreement before you count on it.

What should I text Zach?

Whether you are on salary, a partner or an owner, the property state, and whether you are buying or refinancing. Do not text documents or account numbers; I will tell you what to send and how.
