A straight answer

I had a late mortgage payment. Can I still refinance or get a HELOC?

The direct answer

Often, yes, but the timing matters. Lenders look at how late the payment was, how long ago it happened, and whether the loan is current now, and each program has its own rule. I look at the dates before anything else. I'm Zach von der Linden (NMLS 1652805), a mortgage broker with West Capital Lending, based in San Clemente.

I arrange loans and home equity lines with lenders and put the financing together. Text or call me with when the late happened, how many days late it was, what you owe and what the home is worth, and I will tell you which doors are open now and which need a few more months. I work with homeowners in California, Utah, Oregon and Arizona.

No credit pull happens from a text or a call. The online check is a soft credit pull with no impact on your credit score for the first look. Texts and calls go to Zach's cell.

What happens after you text me?

Texts go straight to my cell, and I answer them myself when I'm free. I'll ask for the few details that actually matter, tell you whether the structure looks worth pursuing, and explain the next step. If I don't think the loan fits, I'll tell you that too.

A text or phone conversation does not pull your credit.

How lenders count a late payment

Three things: severity, recency and current status. Severity is how many days late the payment was reported, in the credit bureau steps of 30, 60, 90 days and beyond. Recency is how long ago it happened; most rules look back over the last 12 months. Current status is whether the loan is paid up today. Fannie Mae's guide spells out that pattern: the lender reviews the credit report for the status of every mortgage and the last 12 months of payment activity, and weighs the severity and recency of any delinquency (Fannie Mae Selling Guide B3-5.3-03).

Conventional refinance: the Fannie Mae rules

Two rules do most of the work. First, on the date of the application your existing mortgage must be current, which Fannie Mae defines as no more than 45 days since the last paid installment date. Second, a loan is not eligible for delivery to Fannie Mae when any mortgage tradeline shows one or more 60-, 90-, 120- or 150-day delinquencies within the 12 months before the credit report date; the guide calls that excessive mortgage delinquency (B3-5.3-03). A single 30-day late is judged on severity and recency with the rest of the file, so it is a conversation, not an automatic no.

Freddie Mac has its own payment-history rules. I could not open that section of its guide on the day this page was written, so I do not restate it here; the lender confirms which set applies to your loan.

FHA refinance: cash-out and streamline

FHA counts a payment as delinquent when it is not paid within the month due. For an FHA cash-out refinance, the handbook requires all mortgage payments made within the month due for the previous 12 months, and the month before closing paid on time. For an FHA streamline refinance that is not credit-qualifying, it requires the payments on the property made within the month due for the six months before the case number, with no more than one 30-day late in those six months; the credit-qualifying streamline applies that six-month rule across all your mortgages (HUD Handbook 4000.1).

VA refinance

A VA Interest Rate Reduction Refinance Loan refinances an existing VA loan to lower the payment or move from an adjustable rate to a fixed one, through a private lender, and if there is a second mortgage its holder has to agree to let the new loan be first (VA.gov). VA sets its own payment-history rule for that loan; I could not open the VA lender handbook chapter the day this page was written, so I state no number here. A Veteran with a late payment should text me the dates and I will check the current rule with the lender.

HELOC after a late payment

A home equity line is the HELOC lender's own program, not a Fannie Mae, FHA or VA loan, so the late-payment rule is whatever that lender sets, and lenders differ. Some want a clean 12 months, some will look at a single 30-day late with an explanation, and the lender reads the payment history since the late as much as the late itself. That is where a broker earns the call: I know which lenders I work with will look at the file. If a bank already said no, that page covers what to do next.

If you are behind right now

Get current first. A conventional refinance requires the existing loan to be current at application, and the FHA and HELOC rules all count forward from the last on-time payment, so a loan that is behind today is not ready for any of them. If you cannot bring it current, your servicer has options, and a Veteran can read VA's help to avoid foreclosure page. Reinstating stops the clock; the refinance or the line comes after.

What to do now

Pull your own credit report and find the mortgage tradeline: the month of the late and how many days late it was reported are the two facts that decide the timing. Keep every payment since then inside the month due. Then text me the dates, what you owe and what the home is worth, and I run a soft-pull scenario with the lenders I work with before anything is filed, so a program that will say no never sees an application.

Buying rather than refinancing? Get pre-approved first. It starts online and uses a soft credit check, with no hard pull for the first look.

Questions people ask next

Does one 30-day late payment stop a refinance?

Not by itself. Conventional lenders weigh how late and how long ago, and the loan has to be current at application; FHA streamlines allow no more than one 30-day late in the six months before the case number. The dates decide it, so send them to me.

How long after a late payment can I refinance?

It depends on the program and the severity. The rules I could verify look back 12 months for serious delinquencies on conventional loans and six to 12 months of on-time payments for FHA refinances. A HELOC lender sets its own window.

Can I get a HELOC if my mortgage is behind right now?

Not until it is current. Lenders count forward from the last on-time payment, so reinstating the loan is the first step; the line comes after.

What if it went further than a late payment?

If the loan ended in a foreclosure, a short sale or a deed-in-lieu, or you went through a bankruptcy, the rules change from a look-back at recent payments to a waiting period that starts when the event ended. Can I buy or refinance after bankruptcy, foreclosure or a short sale? sets out what Fannie Mae, FHA and VA require and which date starts the clock.

Does a late payment on a HELOC count the same as one on the first mortgage?

Both are mortgage tradelines on your credit report, and the program rules above look at every mortgage. How a particular lender weighs each one is part of what I check before you apply.

Will you run my credit to check?

Not to start. I run a soft-pull scenario with the lenders I work with first, so nothing hits your credit until a program is a real fit.

The lender reviews previous mortgage delinquency for severity (30, 60 or 90 days) and recency; loans with excessive prior mortgage delinquency, defined as any mortgage tradeline with one or more 60-, 90-, 120- or 150-day delinquency reported within the 12 months before the credit report date, are not eligible for delivery to Fannie Mae.Fannie Mae Selling Guide, B3-5.3-03, Previous Mortgage Payment History2026-10-10
